1. Acceptance of these Terms

By creating an account on or using the Qafila website ("the Platform"), you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree, do not use the Platform.

2. What Qafila is — and what it is not

Qafila is an online marketplace that connects intending Hajj and Umrah pilgrims ("Pilgrims") with licensed travel agencies ("Agencies") in Bangladesh.

Qafila is NOT a travel agency, tour operator, or Hajj/Umrah organizer. Qafila does not sell, organize, or operate any trip. Qafila is not a party to any contract, booking, or payment between a Pilgrim and an Agency. Any travel contract exists solely between the Pilgrim and the Agency they choose.

3. Accounts and eligibility

  • You must be at least 18 years old and able to enter a binding contract.
  • You must provide accurate, current information and keep it updated.
  • Pilgrim accounts are created with Google sign-in plus a mobile number verified by one-time code.
  • Agency accounts require submission of verification documents: trade license (number and photo), Ministry of Religious Affairs (MoRA) Hajj/Umrah license (number and photo), the responsible person's National ID and passport (numbers and photos), and optionally a HAAB membership license. Agencies may access limited features immediately after submission, but may only place bids after approval by Qafila's administrators.
  • Qafila reviews Agency documents in good faith but does not guarantee, warrant, or certify any Agency, its licensing status, or the quality of its services. Pilgrims must exercise their own judgment.
  • You are responsible for all activity under your account.

4. Requests (RFQs) and bidding

  • A Pilgrim may post a trip request ("RFQ"). Bidding on an RFQ stays open for 24 hours from posting and closes automatically.
  • Each bid an Agency places costs 1 token (see Section 5).
  • An RFQ that receives no bids within 24 hours is nullified; the Pilgrim may post a new one.
  • While a Pilgrim has an open RFQ with zero bids, they may not post another RFQ until 24 hours have passed or they cancel it manually; manual cancellation is only available once the RFQ has been open for at least 12 hours.
  • Once an RFQ has received at least one bid, it can no longer be cancelled, and the Pilgrim may not post another RFQ until they accept one of the bids received.
  • A Pilgrim may accept exactly one winning bid per RFQ.
  • On acceptance, contact details are exchanged as follows, and you consent to this exchange as a core function of the Platform: the winning Agency receives the Pilgrim's name, phone number, and email address; the Pilgrim receives the winning Agency's name and phone number; losing Agencies are informed of the winning Agency's name.
  • Certain bids may be displayed with priority placement and marked with an "Ad" label where the Agency has purchased advertising (Section 6).

5. Tokens and payments to Qafila

  • Tokens are prepaid platform credits used by Agencies to place bids. Tokens are not money, e-money, or a financial instrument; they have no cash value, cannot be transferred between accounts, and cannot be exchanged for cash.
  • Token price: 20 BDT per token. Bundles: 10 tokens = 200 BDT; 50 = 1,000 BDT; 100 = 2,000 BDT; 500 = 10,000 BDT; 1,000 = 20,000 BDT. A 10% discount applies to the 1,000-token bundle only.
  • 15% VAT applies to every purchase and is shown separately before payment.
  • New Agencies receive 10 free promotional tokens once, upon first registration. Promotional tokens carry no cash value.
  • Payments are processed by third-party payment gateways (including AamarPay). Qafila does not store your card details.
  • Tokens spent on bids are not refundable. Unspent tokens are not refundable except where required by law or under Section 8.
  • Qafila may change token prices, bundles, or promotions prospectively with notice on the Platform.

6. Advertising placements

Agencies may purchase bid placement advertising at 300 BDT per day, for any number of days, subject to VAT. While active, the Agency's bids are shown at the top of bid lists with distinct styling and an "Ad" label. Advertising does not constitute Qafila's endorsement of the Agency.

7. Trip payments happen outside Qafila

All payments for the trip itself — packages, flights, accommodation, visas, or any other travel service — are made directly between the Pilgrim and the Agency, outside the Platform. Qafila does not collect, hold, process, or safeguard trip payments, and bears no responsibility for them, including their amount, method, receipt, or refund.

8. Fraud reports and enforcement

  • Pilgrims may report suspected fraud by an Agency through the Platform. Qafila's administrators decide, at their sole discretion, what action to take.
  • Qafila may suspend or terminate any account, remove content, withhold bidding access, or freeze an Agency (including reversing recent token effects consistent with our internal fraud policy) where it reasonably suspects fraud, document forgery, abuse, or breach of these Terms.
  • Qafila may cooperate with law-enforcement and regulatory authorities.

9. Reviews and acceptable use

  • Pilgrims may rate Agencies out of 5 stars with a written review. Reviews must be honest and based on genuine experience.
  • You must not: post false RFQs, bids, or reviews; impersonate others; upload forged documents; harass other users; attempt to circumvent token charges; scrape, reverse-engineer, or interfere with the Platform; or use it for any unlawful purpose.

10. Intellectual property

The Platform, its design, branding, and content (excluding user-submitted content) belong to Tawakkul Distribution. You receive a limited, revocable, non-exclusive right to use the Platform for its intended purpose. You grant Qafila a license to display content you submit (RFQs, bids, reviews) on the Platform.

11. Disclaimers

The Platform is provided "as is" and "as available". Qafila does not warrant uninterrupted or error-free operation, and does not warrant the accuracy of information submitted by users, including Agency documents, bids, or reviews. Qafila makes no warranty regarding any trip, its performance, quality, safety, or compliance with MoRA or Saudi requirements.

12. Limitation of liability

To the maximum extent permitted by the laws of Bangladesh, Qafila's total liability to any user for all claims arising from the Platform is limited to the amount that user paid to Qafila in the 12 months before the event giving rise to the claim. Qafila is not liable for indirect, incidental, or consequential losses, or for any loss arising from a trip, an Agency's acts or omissions, or dealings between users.

13. Indemnity

You agree to indemnify Qafila against claims, losses, and expenses arising from your breach of these Terms, your content, or your dealings with other users.

14. Termination

You may stop using the Platform at any time. Qafila may suspend or terminate accounts for breach of these Terms. Sections that by their nature should survive (including 5, 7, 10–13, 15) survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the People's Republic of Bangladesh. Disputes are subject to the courts of Dhaka, Bangladesh.

16. Changes to these Terms

Qafila may update these Terms. Material changes will be announced on the Platform; continued use after the effective date constitutes acceptance.
